The current Covenants at Article 1 state:

23.  Only those motor vehicles which are State registered and licensed will be allowed to operate on West Shores subdivision roads. . . .

27. Operating snowmobiles, ATV’s and other non-licensed motorized vehicles . . . on the common areas and streets within the West Shores Subdivision . . . . Is prohibited.

There has been controversy regarding golf carts in the past year, particularly involving underaged/unlicensed drivers.

Nebraska law permit communities such as Waterloo and subdivisions like West Shores to authorize the operation of ATV’s, UTV’s and/or Golf Carts , but only if:
(1) by licensed drivers at least 16 years old,
(2) of a registered vehicle,
(3) having lights and a 5’ safety flag,
(4) between sunrise and sunset,
(5) having liability insurance and
(6) at speeds not more than 30 mph.

Approval of a covenant amendment requires 75% of lot owners.

LOT OWNER COMMENTS:

Golf cart/4 wheeler. If it takes putting on a flag and registering the cart to keep it, this family would abide by any new rules the board would put in place.

ATV’s – We are in favor of allowing ATV’s, golf carts. The proposed rules should allow operation after dark with headlights, tail lights.
